1. Who we are
This Privacy Policy applies to Nex Financial Inc. ("Nex Financial," "we," "us," or "our"), a commercial finance brokerage incorporated in Canada with its head office at 3080 Yonge Street, Suite 6060, Toronto, Ontario M4N 3N1. We are a "broker" of commercial finance products — we do not lend our own capital. We are responsible for the personal information we collect under the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial private-sector privacy legislation.
2. What personal information we collect
We collect only the information we need to provide our services. Depending on how you interact with us, this may include:
Information you give us directly
- Identification: full legal name, date of birth, residential address, email address, telephone number, government-issued ID (when required for KYC).
- Business information: company legal name, operating name, business number, incorporation details, ownership structure, principals and guarantors, industry, years in business, locations served.
- Financial information: annual and monthly revenue, profit and loss statements, balance sheets, bank statements, accounts receivable aging, existing debt obligations, equipment lists, asset appraisals, tax filings.
- Credit information: personal and business credit reports (with your consent), credit scores, prior commercial credit history.
- Application content: the financing product you are applying for, requested amount, intended use of funds, and any other information you choose to share.
Information we collect automatically
- Technical data: IP address, browser type and version, device type, operating system, language, time zone, pages visited, referring URL, and the date and time of your visit.
- Analytics: aggregated, non-identifying usage data that helps us improve the site (see Cookies and analytics).
Information from third parties
- Credit bureaus (Equifax Canada, TransUnion Canada) with your consent.
- Public registries (corporate registries, PPSA / RDPRM filings) to verify business standing and existing security interests.
- Lenders, funders, and equipment vendors we work with on your behalf to structure your file.
3. Why we collect it
We collect personal information for the following identified purposes:
- To evaluate, structure, submit, and shop your application across our lender network.
- To verify your identity and meet our obligations under anti-money-laundering law (FINTRAC), anti-fraud screening, and "know-your-customer" requirements.
- To communicate with you about your application, the financing options available to you, and ongoing servicing if your facility funds.
- To respond to inquiries you submit through our contact forms, email, or telephone.
- To detect and prevent fraud, secure our systems, and protect our legal interests.
- To comply with applicable laws, regulations, court orders, and lawful requests by public authorities.
- With your express consent, to send you optional information about products, market updates, or industry insights. You can withdraw consent at any time.
We will not use your personal information for new, materially different purposes without first obtaining your consent.
4. How we share information
We do not sell personal information. We share it only with the parties below, and only to the extent necessary for the purposes above:
- Lenders, funders, and finance companies in our network, so they can underwrite and price your file. Each receives only what is required for their decision and is bound by their own privacy obligations.
- Credit bureaus for credit checks (with your consent) and to report payment performance on funded facilities where applicable.
- Service providers who help us operate the business — including hosting, application infrastructure, email, document storage, electronic signature, identity verification, and analytics — all under contract that restricts use of the information to the services they provide.
- Professional advisors (lawyers, accountants, auditors) under duties of confidentiality.
- Government and regulatory bodies where required by law (for example, FINTRAC reports, court orders, valid subpoenas, or tax authority requests).
- In connection with a corporate transaction (merger, acquisition, financing, reorganization, or sale of substantially all of our assets), subject to the same privacy commitments.
5. How long we keep your information
We retain personal information only for as long as needed to fulfill the purposes for which it was collected and to meet our legal and regulatory obligations. In practice:
- Funded files: retained for the term of the facility plus seven (7) years after the final payment, consistent with Canadian tax and AML record-keeping requirements.
- Unfunded or withdrawn applications: retained for up to two (2) years, then destroyed or anonymized, unless a longer period is required by law.
- Marketing contact details: retained until you unsubscribe or withdraw consent, plus a short period to ensure the unsubscribe is honored.
- Website logs: retained for up to 24 months for security and fraud prevention.
6. How we protect your information
We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including:
- TLS / HTTPS encryption in transit across our website and application portal.
- Encryption at rest for stored applicant files.
- Role-based access controls so that only Nex staff with a need-to-know can see your file.
- Multi-factor authentication on systems holding personal information.
- Confidentiality and security obligations in contracts with service providers.
- Staff training on privacy and information security.
No method of electronic transmission or storage is perfectly secure. We do not guarantee absolute security but commit to acting promptly and transparently in the event of a breach that creates a real risk of significant harm, as required by PIPEDA.
7. Your rights
Subject to limited legal exceptions, you have the right to:
- Access the personal information we hold about you.
- Correct information that is inaccurate or incomplete.
- Withdraw consent for any use we make of your information, subject to legal or contractual restrictions (for example, we may not be able to continue servicing a funded facility without certain information).
- Receive an explanation of why we collected, used, or disclosed information.
- File a complaint with our Privacy Officer (see Contact) and, if not satisfied, with the Office of the Privacy Commissioner of Canada at priv.gc.ca.
We will respond to verifiable requests within thirty (30) days. We may charge a reasonable fee for very large or repeated access requests, and will tell you in advance if any fee applies.
8. Cookies and analytics
This website uses a small number of cookies and similar technologies:
- Strictly necessary cookies for security, fraud prevention, and basic site functionality. These cannot be disabled in our systems.
- Analytics cookies (where enabled) to understand how the site is used and improve content. We use only aggregated, non-identifying metrics.
You can configure your browser to refuse cookies. Some parts of the site may not function correctly if you do so.
9. Cross-border transfers
Some of our service providers store data outside of Canada (typically in the United States). When personal information is processed outside Canada, it may be subject to the laws of that jurisdiction, including lawful access by foreign authorities. We require these providers, by contract, to protect personal information at a standard comparable to PIPEDA.
10. Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top of the page reflects the latest version. Material changes will be communicated through a prominent notice on this page or, where appropriate, by direct contact.
